Mirena® IUD Lawsuit Claim

Increased Complaints of Injuries Resulting From Bayer’s Mirena® IUD

The Mirena® intrauterine device (IUD), a device inserted into the uterus for up to five years to prevent pregnancy or treat heavy periods, is increasingly the subject of complaints – and now litigation – from women who have suffered unexpected and often harmful side effects as a result of its use.  The device, manufactured by Bayer HealthCare Pharmaceuticals, Inc, and first approved by the U.S. Food and Drug Administration (FDA) in 2000, was used by more than 2 million women in the U.S. as of 2010.

According to data gathered by Adverse Events, Inc., more than 45,000 reports of serious adverse events involving the Mirena® IUD have been filed with the FDA.  The most common complaints were device expulsion, device dislocation, and vaginal hemorrhage. In addition, serious injuries alleged to have resulted from the use of Mirena® have included:

  • Perforation of the uterine wall,
  • Migration of the device outside the uterus,
  • Life-threatening infections, and
  • Surgical removal of the Mirena®  IUD.

While there has been no recall or other action taken by the FDA regarding the threats posed by the Mirena® IUD, the FDA has previously admonished Bayer for minimizing the risks of Mirena® in its advertising. Specifically, in a 2010 warning letter to Bayer, the FDA wrote that Mirena® advertising “overstates the efficacy of Mirena®, presents unsubstantiated claims, minimizes the risks of using Mirena®, and includes false or misleading presentations regarding Mirena®. Thus, the program misbrands the drug in violation of the Federal Food, Drug, and Cosmetic Act…”
