Louisiana Couple Sues After Tractor-Trailer Accident

A Louisiana couple has sued after their vehicle was involved in an accident with a tractor trailer.A Louisiana couple has filed a personal injury lawsuit against Star Transportation and a co-defendant after their vehicle was hit by a tractor-trailer, according to the Southeast Texas Record.

The lawsuit states that Bennet and Gloria Cady were driving east bound on Interstate 20 on May 26, 2009, when their car was hit by the tractor trailer while the larger vehicle was attempting to change lanes. The news source said the tractor trailer initially hit a car traveling in front of the plaintiffs' before swerving and colliding with their car as well.

The driver, Jonathan Carnahan, is accused of negligence for failing to maintain a proper lookout, failing to control speed, failing to maintain proper control of his vehicle, failing to maintain an assured clear distance and failing to properly and timely apply the brakes.

Although the media report did not specify how the Cadys were injured, it said they are seeking damages for physical pain and suffering, mental anguish, physical impairment, medical expenses, loss of earnings, disfigurement, loss of household services and court costs. The plaintiffs have requested a jury trial.

In May, the National Transportation Safety Bureau held a two-day forum regarding truck and bus safety after a series of commercial vehicle accidents. Some have suggested that limiting work hours and requiring drivers to take mandatory rest breaks could reduce crash incidents.
