Lawsuit filed over boy's parking ramp deathA woman whose 4-year-old son was killed due to a collision inside a parking garage has filed a personal injury lawsuit against the driver who ran him over and the owner of the vehicle in question.

Police said that Colette Volkema DeNooyer was driving around a hospital parking structure when Izaiah Casillas darted in front of her vehicle, according to the Holland Sentinel. DeNooyer then struck the child with her car and ran over his body, and he died about an hour later, the personal injury lawsuit states.

The suit also claims that DeNooyer had been waiting for a car to turn into a parking space prior to the accident. When the road was clear, she allegedly accelerated and failed to keep a proper lookout, thus striking the boy, the Grand Haven Tribune reports. The Casillas family also allegedly yelled at DeNooyer to warn her of the boy's presence in her path.

Robert DeNooyer Chevy Incorporated, the owner of the vehicle, is also named as a defendant in the suit, as it is claimed that the company allowed the allegedly negligent DeNooyer to drive the vehicle.

The Ottawa County Prosecutor’s Office has said that no criminal charges will be filed against DeNooyer. In her civil suit, the boy's mother, Terra Fay Potter, seeks more than $25,000 in damages, according to the news source.
