Smaltz was allegedly ejected from the vehicle due to the collision and died, according to KCBD.com. The car accident lawsuit also claims that Roberts was intoxicated at the time of the wreck.

Smaltz’s daughter, who was in the car at the time of the crash, has filed the car accident lawsuit against Roberts, her father and the car dealership that owned Roberts’ vehicle, according to the news source. Her lawsuit claims that Roberts’ speeding and drunk driving were “without a legal excuse”, and she is asking a jury to determine damages.

Roberts and her passenger suffered minor injuries in the crash. She has already been charged with manslaughter and intoxicated assault, the news provider reports.
